IFiDEA respects the rights of artists, makers and everyone who creates the things collectors love. We respond to notices of alleged copyright infringement under the Digital Millennium Copyright Act (17 U.S.C. § 512), and we expect our members to do the same.
How to reach us
Email our copyright agent at [email protected] with “DMCA Notice” in the subject line. Email is the fastest way to reach us. Our agent is registered with the U.S. Copyright Office (Registration No. DMCA-1082187).
How to send a notice
If you believe something on ifidea.com infringes a copyright you own or are authorized to act for, send our agent a written notice that includes:
- Your physical or electronic signature.
- The copyrighted work you believe is being infringed (or, for several works, a representative list).
- The material you want removed and where it is on our site — the page URL is best, plus a description if the page has several images.
- Your name, mailing address, phone number and email address.
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner’s behalf.
When we receive a complete notice, we remove or disable access to the material promptly. If a member posted it, we let them know and share a copy of the notice.
If your content was removed by mistake
If you posted something that was removed and you believe it was a mistake or misidentification, you can send our agent a counter-notice that includes:
- Your physical or electronic signature.
- The material that was removed and where it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Your name, address and phone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if you are outside the United States, any judicial district in which IFiDEA may be found), and that you will accept service of process from the person who sent the original notice or their agent.
After we receive a valid counter-notice, we forward it to the person who sent the original notice. Unless they tell us within 10 business days that they have filed a court action, we may restore the material 10 to 14 business days after receiving the counter-notice.
Repeat infringers
In appropriate circumstances, we disable or close the accounts of members who repeatedly infringe the copyrights of others.
Photos on IFiDEA
Product photos on our site come from the makers, brands and distributors whose products we carry or document, and are used to identify those products. Photos that members upload to My Shelf belong to the members who post them, and members may only upload photos they took themselves or have permission to share. If you are a rights holder and believe any image here is used without authorization, contact our agent and we will look at it right away.
Please be accurate
Under 17 U.S.C. § 512(f), anyone who knowingly misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages. If you are not sure whether something infringes your rights, consider talking to a lawyer first.
